Terms of service
Terms of service
Effective October 25, 2026, for new quote requests and orders accepted after publication. Earlier orders remain subject to the terms accepted when they were placed.
1. About Threadborne Co.
These terms apply to the Threadborne Co. website, quote requests, custom embroidery, sample orders, and merchandise drops. Threadborne Co. is the embroidery business previously known as The Oddball Emporium. In these terms, “we,” “us,” and “our” mean that business. Contact us at threadborneco@gmail.com.
You must have legal capacity to enter an agreement and, when ordering for a business, event, or team, authority to act for that customer. Your written quote or order confirmation identifies the seller, the customer, and the agreed order details.
2. Quote requests and order acceptance
A quote request is an inquiry. Submitting the form, uploading artwork, or receiving an automated acknowledgment does not place an order, reserve production time, approve a design, or authorize payment.
Before a custom order is accepted, we will provide the price, specifications, payment requirements, and estimated timing for your approval. A custom order is accepted when you approve the final written quote and we confirm acceptance. We will not begin chargeable digitizing or production without your approval of that work and its price.
For website merchandise purchases, the product listing and checkout show the order details. If we cannot fulfill an order, we will contact you and refund payments for unfulfilled items as required by law. We do not change an accepted order’s price or specifications without your agreement.
3. Pricing, digitizing, and payment
Custom pricing depends on the garment, quantity, colors, stitch count, complexity, design size, and placements. There is no minimum quantity for businesses, events, or sports teams, and sample orders are welcome.
Digitizing converts artwork into a machine-readable DST embroidery file. The digitizing fee starts at $10; the actual fee and scope will be stated before you approve that work. Any file delivery or reuse rights will be stated in the quote; paying for digitizing does not transfer ownership of someone else’s artwork.
Taxes, shipping costs, payment timing, and any deposit or balance requirement will be disclosed in the quote or checkout before payment. No deposit amount or payment deadline is imposed by these website terms alone.
Any payment-processing fee must be disclosed before you approve and pay, permitted by applicable law and the payment provider’s rules, and no greater than the provider’s charge or a lower applicable limit. We do not add a fee to a payment method when the law or provider prohibits it.
4. Artwork permissions
You confirm that you own your submitted artwork or have permission from the rights holder to use and reproduce it on the requested items. This includes logos, trademarks, designs, images, and other protected material. We may request evidence of permission or decline work that appears unauthorized.
You grant us a limited, nonexclusive permission to receive, store, adapt for embroidery, digitize, and reproduce the submitted artwork only as needed to prepare your quote and fulfill work you approve. We may provide it to service providers assisting with those purposes.
You retain your rights in your original artwork. Uploading artwork does not give us unrestricted publishing or resale rights. We will obtain separate permission before using your nonpublic artwork or identifiable custom order in advertising or a portfolio.
5. Design and order approval
Before production, review the written specifications and any proof provided, including spelling, artwork, thread colors, design size, garment colors and sizes, quantities, and every placement. Tell us about mistakes or changes before approving. Production follows the final approved specifications.
A screen image or digital mockup is a preview, not an exact stitch sample. Fabric, garment construction, thread, and embroidery can produce reasonable differences in color, texture, and placement. If an exact color, measurement, or sample is essential, tell us before approval so we can confirm what is achievable.
Your approval records the choices you made; it does not excuse us from following the approved specifications or remove rights concerning defective, incorrect, or misrepresented work.
6. Customer-supplied garments
Embroidery is permanent. Customer-supplied garments are accepted at your own risk, subject to your legal rights. Although every item is handled with care, fabric damage, needle marks, or stitching issues can occur.
Threadborne Co. does not replace or reimburse customer-supplied garments damaged during embroidery, to the extent permitted by law. This policy does not exclude liability that cannot legally be excluded, including gross negligence or intentional misconduct.
Tell us about garment condition, special care instructions, and unusual or irreplaceable items before work begins. We may decline unsuitable garments. Customers supplying garments must acknowledge this policy separately on the quote form.
7. Turnaround, deadlines, and delivery
Normal custom-order turnaround is about two weeks, but it varies by order. Your quote will confirm the estimated completion date and when the production timeline begins, including any required approvals, payment, and receipt of garments. An event date entered on a request is not a promised deadline unless we expressly agree to it in writing.
Production time and carrier transit time are separate. Shipping availability, charges, delivery method, and any pickup arrangement are confirmed in the quote or checkout. Merchandise drops follow the fulfillment estimate shown with the product or order.
If we cannot ship within the stated time, we will notify you and seek consent to a revised shipment date or provide cancellation and refund options as required by law. If no shipping time is stated for an order covered by the FTC merchandise-order rule, the rule’s 30-day timeframe applies. We will not keep payment for unshipped merchandise when a refund is legally required.
8. Changes, cancellations, and final sales
Request changes or cancellation promptly at threadborneco@gmail.com. Once materials are committed, digitizing is performed, or production begins, changes or cancellation may not be possible. We will confirm any agreed change, additional cost, or revised timing in writing before performing additional chargeable work.
All sales are final. We do not accept change-of-mind returns or offer discretionary refunds for custom embroidery, samples, or merchandise drops, except where required by law. A cancellation request does not automatically create a refund entitlement; any agreed cancellation terms and lawful charges must follow your approved quote and applicable law.
This does not remove remedies for defective, incorrect, or misrepresented goods or services, legally required shipment-delay refunds, or other rights that cannot be waived. If we cancel work we cannot fulfill, we will return the payment due for that unfulfilled work as required by law.
9. Problems with an order
Contact threadborneco@gmail.com promptly if an order is damaged, defective, incorrect, or missing. Include the order or quote reference, a description, and photos when available. Keep the items and packaging while we review the issue, and contact us before sending anything back so we can provide instructions.
We will assess the issue against the approved specifications and applicable law. A repair, replacement, refund, or another remedy may be appropriate depending on the circumstances and your legal rights. Prompt reporting helps us investigate; these terms do not shorten a legally applicable claim period.
10. Lawful use, privacy, and service providers
Use the website lawfully and provide accurate information. Do not upload malicious files, impersonate others, misuse the quote form, or submit content that violates another person’s rights. We may refuse unlawful or unsafe work, or restrict misuse of the website, subject to applicable law.
Our Privacy Policy explains how we handle personal information. We use service providers for the storefront, quote hosting, secure file storage, email delivery, and payment processing. A provider’s separate terms may apply when you use that provider’s service.
11. Responsibility and limits
We are responsible for performing the work we agree to provide and for obligations imposed by applicable law. Website availability may occasionally be interrupted; contact us by email if you cannot submit or access a request.
To the extent permitted by law, neither party is liable to the other for indirect or consequential business losses, such as lost profits or lost business opportunities, arising from an order. This clause does not exclude direct remedies for defective or incorrect work.
Nothing in these terms excludes or limits fraud, intentional misconduct, gross negligence, liability for injury where it cannot lawfully be limited, or any warranty, consumer right, or remedy that applicable law does not allow us to exclude. Mandatory legal protections take priority over inconsistent wording.
12. Governing law and resolving concerns
Washington State law and applicable United States federal law govern these terms, without depriving a customer of mandatory protections that apply where they live.
Please contact threadborneco@gmail.com so we can try to resolve a concern. You retain the right to bring a claim in a court with lawful jurisdiction, use an eligible small-claims process, contact a regulator, or exercise payment-dispute rights. These terms do not require arbitration or waive those rights.
13. Which terms apply
These terms, the Returns and Refunds Policy, the Shipping and Delivery Policy, and your accepted written quote or order confirmation form the agreement for an order. Specific order details expressly agreed in writing take priority over general website wording, subject always to mandatory law. The Privacy Policy governs personal information.
Updates apply prospectively from publication. They do not retroactively change accepted orders without agreement. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
